Theory of supplication of Justice. For the necessary citizenization of the justice and peace

Abstract:

This article is intended to justify the existence of a theory, the theory of the supplication of Justice, which has as its main elements: the alternate dispute resolution methods, the peace, the intangibles of ADR, the alternative justice and restorative justice, the traditional patterns of teaching and law enforcement, that with the passage of time have collapsed and make large instrumental differences with the alternative justice. We point to the theory of supplication of justice as a transitive theory, which solves the conflict that gives its own name, the supplication of justice, which equally considers citizenization of justice as an element sine qua non of the paradigm of «resolving our own conflicts ourselves» as a constituent element of the theory. It determines that this new theory will be the one who orders growth and culturization of ADR, approves its instrumental process and contribute the elements requiring the science of mediation and ADR, in favor of its evolution and future consideration as a profession.

Resumen:

En este artículo se pretende justificar la existencia de una teoría, la teoría de la impetración de la justicia, que tiene como principales elementos a los métodos alternos de solución de conflictos (MASC), a la paz, a los intangibles de los MASC, a la justicia alternativa y a la justicia restaurativa, a los esquemas tradicionales de impartición y procuración de justicia que con el paso del tiempo se han colapsado y marcan grandes diferencias instrumentales con la justicia alternativa. Se señala a la teoría de la impetración de la justicia como una teoría transitiva, que viene a resolver el conflicto que la da su propio nombre, el de la impetración de la justicia, que de igual forma considera a la ciudadanización de la justicia como elemento sine qua non del paradigma de “resolver nosotros mismos nuestros conflictos”, como elemento constitutivo de la teoría. Se determina que esta nueva teoría será quien ordene el crecimiento y culturización de los MASC, homologue su proceso instrumental y aporte los elementos que requiere la ciencia de la mediación y de los MASC, en pro de su evolución y futura consideración como una profesión.
